Supreme Court of Brazil Requests Further Documentation from Elon Musk’s X

The Supreme Court of Brazil has issued additional requests for documentation from Elon Musk, the owner of X, following the shutdown of the social media platform in August. The court’s actions were in response to X’s failure to comply with an order to appoint a new legal representative for the company in Brazil by a specified deadline.

Despite initially resisting the ruling, Musk eventually acquiesced, stating that the company had appointed a lawyer. However, Federal Judge Alexandre de Moraes has now demanded further documents and given X a five-day deadline to provide documentation regarding the appointment of attorney Rachel Conceicao as the legal representative of X within Brazil.

What were the Supreme Court’s orders?

In August, Justice de Moraes ordered the suspension of X until it adhered to the Supreme Court’s rulings. These rulings included the nomination of a legal representative in Brazil and the payment of fines totaling 18.35 million reals (approximately $3.28 million, €3 million). De Moraes also froze the assets of X and Musk’s satellite internet operator, Starlink, to ensure the payment of fines imposed on the social network for violating court orders.

While Musk initially indicated that X would not comply with the order, the company announced on Friday that Conceicao had been appointed as their lawyer. However, de Moraes has requested a power of attorney from the lawyer for X in Brazil and proof of her proper registration with the Chamber of Commerce of the State of São Paulo, as stated in the decision of the Supreme Federal Court.

Brazilian law mandates that all internet companies must have a legal representative in the country to receive legal notifications and take necessary actions. Earlier this month, X removed its legal representative from Brazil after de Moraes threatened her with arrest, escalating tensions between Brazilian authorities and Musk.
